UNIBAN PRIVACY POLICY

PURPOSE


UNIBAN CANADA inc. its affiliates and subsidiaries ("UNIBAN") values the privacy of its customers, employees and suppliers. UNIBAN’s collection, use, communication and disclosure of personal information will comply with this Privacy Policy.

SCOPE AND APPLICABILITY


The UNIBAN Privacy Policy governs all collection, use, communication and disclosure of personal information by UNIBAN. The UNIBAN Privacy Policy does not apply to information that is exempted from the definition of “personal information” in applicable privacy statutes.

UNIBAN PRIVACY ORGANIZATION STRUCTURE


Privacy enquiries regarding UNIBAN’s stores or UNIBAN web sites, should be directed at UNIBAN head office, 2115, boul. Des Laurentides, Laval (Québec) H7M 4M2, for the attention of Chief privacy officer.

COLLECTION AND USE OF PERSONAL INFORMATION


In accordance with prior express and specific consent, UNIBAN may collect some of the following personal information:
• Name and last name;
• Gender;
• Age and/or date of birth;
• Street address and/or workplace address;
• Email address;
• Banking information, credit card number, expiration date, card holder name, CVV, CVD;
• Insurance information such as insurer name, insurance policy reference number and validity, etc.

UNIBAN may collect personal information from you when you:
• Purchase, rent, order, return or exchange any of our products and services;
• Request delivery, warranty or repair services;
• Make a credit application;
• Contact UNIBAN Customer Service or the store manager in one of our stores;
• Visit Uniban web sites;
• Enter into a contest or respond to one of our surveys;
• Provide Uniban with comments or suggestions; or
• Are injured on, or suffer or cause property damage on, UNIBAN premises;
• Are in employment with Uniban;
• Offer a consultation service to Uniban

UNIBAN may also conduct video surveillance of its stores and other premises strictly for security and loss prevention reasons.

UNIBAN may use personal information, where such is necessary, to:
• identify customers, employees and suppliers and to establish and maintain a relationship with them
• provide customers with ongoing service, including to process orders, to ensure proper delivery and to better assist customers when they visit or call Uniban customer service
• improve UNIBAN product and service offerings
• provide UNIBAN customers with information about other UNIBAN products and services that may be of interest to them
• protect against error and fraud
• comply with legal and audit requirements

UNIBAN may also use personal information to create statistics about its business. These statistics do not contain any information that could personally identify any individual customer, employee or supplier.

OTHER USES OF PERSONAL INFORMATION


In the event that all or part of UNIBAN’s assets were sold or financed, or if UNIBAN were to merge with another company, personal information in the possession of UNIBAN could be disclosed to the lender, buyer or merger partner, provided such personal information were to be used in strict compliance with the UNIBAN Privacy Policy.

UNIBAN may also disclose your personal information in response to a search warrant or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required by law. We may also disclose personal information to assist us in collecting any debt owed by you.

DISCLOSURE AND COMMUNICATION OF PERSONAL INFORMATION


UNIBAN will not trade, rent or sell your personal information to any third party unless it tells you about it and obtain your consent.

UNIBAN will no communicate your personal information to anyone unless they are necessary for a third party to provide you services in cooperation with UNIBAN. Indeed, some products and services that are provided through UNIBAN (such as credit cards, extended warranties and installation and repair services) may be provided by third parties in cooperation with UNIBAN. In order to provide you with the products or services that you request from UNIBAN, it may be necessary to UNIBAN to transfer information about you to these third parties.

When UNIBAN transfers personal information to third parties for processing on behalf of UNIBAN, a contract containing appropriate privacy protection terms will be in place before any information is transferred to the third party. These terms must provide that the third party will not use the personal information for their own purposes, will keep the personal information secure, and will only process the information on the instructions of UNIBAN in accordance with purposes mentioned in previous sections “Collection and Use of Personal Information” and “Other Use of Personal Information”. In addition, using certain third party products to purchase products or services from UNIBAN (such as a credit card not issued by UNIBAN) may require us to provide your personal information to third parties in order to process the transaction.

COOKIES, SOCIAL MEDIA AND BLOGS


Cookies are small bits of data (technical information) sent by a website server to the browser of your computer and stocked on your computer, mobile device or browser.
When you visit UNIBAN’s website, technical information transmitted by your browser are gathered by UNIBAN, such as the type and language of browser used, operating system, pages viewed, web log files, frequency of access and IP address.

UNIBAN does not develop a profile of your computer and UNIBAN does not use cookies to retrieve information from your hard drive that was not originally sent in a cookie.

UNIBAN’s website includes social media functions which gather IP address and send cookies to achieve some functions. Functions and widgets are hosted by a third party, but your interactions with same are managed by this Privacy Policy.

You can modify such options in your web browser to avoid receiving cookies or to set your browser to notify you when receiving a cookie. However, the quality and efficiency of services provided by UNIBAN may be affected when cookies are disabled.

INDIVIDUAL ACCESS TO AND CORRECTION OF THEIR PERSONAL INFORMATION EXCEPTIONS


An individual’s request for access to his personal information in the possession of UNIBAN should be directed to UNIBAN at 2115, boul. Des Laurentides, Laval (Québec) H7M 4M2 for the attention of the Chief privacy officer. In order to verify that the information is being released to the proper person, individuals may be asked to provide suitable identification or to otherwise identify themselves.

An individual may ask for update, correct, complete, erase or make anonymous any of their personal information that UNIBAN has its possession by contacting UNIBAN at 2115, boul. Des Laurentides, Laval (Québec) H7M 4M2 for the attention of the Chief privacy officer and making a written request. Individuals may be asked to provide suitable identification or to otherwise identify themselves before any corrections will be made, and UNIBAN reserves the right to request appropriate proof of the correctness of any of the requested corrections and refuses said request for legal purpose. UNIBAN will answer to the request within 30 days of the receipt of such request.

WITHDRAWAL OF CONSENT


Individuals may withdraw their consent to UNIBAN’s use or disclosure of their personal information by contacting the UNIBAN Privacy Officer and making a written request. Individuals may be asked to provide suitable identification or to otherwise identify themselves. The request should be directed to

In some circumstances, the withdrawal of consent to certain uses or disclosures of personal information may mean that UNIBAN is no longer able to provide certain products or services to the individual or may be unable to process returns, exchanges or refunds. If this is the case, UNIBAN will inform you when you contact us to withdraw your consent and give you the choice.

Upon withdraw of consent, UNIBAN will cease any use of personal information referred and proceed to destruction of same, subject to legal requirements related to their conservation and will inform third party of such request, if applicable.

RECORD RETENTION/DESTRUCTION AND SECURITY


UNIBAN will only retain personal information for as long as it is necessary to process related transactions, maintain appropriate financial and audit records and protect UNIBAN’s legitimate commercial interests.

All personal information collected by UNIBAN is retained at 2115, boul. Des Laurentides, Laval (Québec) H7M 4M2 and is protected by security measures appropriate to the sensitivity of the information to ensure its privacy, such as encryption, secure server, firewall, employee training, etc. All personal information stored in electronic form, including all information collected through the UNIBAN web sites, is kept in confidential and secure data banks.

UNIBAN evaluates its equipment and security procedures regularly and modifies them if necessary, so it can remain at the leading edge of security technology.

Only a restricted number of the employees of UNIBAN, its affiliates and subsidiaries will have access to your personal information. Employees’ access will be exclusively permitted to personal information that is necessary for the achievement of the purposes mentioned in previous sections “Collection and Use of Personal Information” and “Other Use of Personal Information” When personal information is no longer needed, it will be destroyed according to the security policies in place.

CHANGING THE UNIBAN PRIVACY POLICY


UNIBAN reserves the right to change the UNIBAN Privacy Policy at any time without notice. Any modification of the UNIBAN Privacy Policy will be published on the UNIBAN web sites and communicated to employees and suppliers. Users are therefore encouraged to visit the UNIBAN Privacy Policy section of the UNIBAN web sites regularly or via the following electronic link:

Placing an order through the UNIBAN web sites after modifications have been published constitutes acceptance of those modifications to the UNIBAN Privacy Policy.

REMEDIES AND COMPLAINTS


An individual may file with the local authority responsible for protection personal information a written complaint against UNIBAN in case of any contravening with this Privacy Policy or a legal requirement.

VERSIONS


In the event of a discrepancy between the English and French versions of this Privacy Policy, the English version shall take precedence.
